These General Terms and Conditions govern the purchase of the services offered on the website https://teacherpresto.com , owned by Fiona Leamon Mackenzie (hereinafter referred to as TEACHER PRESTO).
The purchase of any of the services implies full and unreserved acceptance of each and every one of the General Conditions indicated, without prejudice to the acceptance of any Special Conditions that may be applicable to the purchase of certain services.
These General Conditions may be modified without prior notice, therefore, it is advisable to read their content carefully before proceeding to purchase any of the services offered.

The website www.teacherpresto.com offers the possibility of booking private English classes (individual or group) online or in person, where people who want to learn English are put in contact with teachers. The student can book an English class with one of the private teachers through the website.

All notifications and communications between users and TEACHER PRESTO shall be considered effective, for all purposes, when they are made by any of the aforementioned means.
3. SERVICES
The services offered, together with their main characteristics and prices, are displayed on the screen.
TEACHER PRESTO reserves the right to decide, from time to time, the products and/or services offered to Customers. TEACHER PRESTO may, at any time, add new products and/or services to those currently offered.
Furthermore, TEACHER PRESTO reserves the right to withdraw or cease to offer, at any time and without prior notice, any of the services offered.
This is without prejudice to the fact that the acquisition of any of the services may only be made by means of the USER’s subscription or registration, with TEACHER PRESTO providing the interested party with a user name and password, which shall identify and personally enable him/her to access the services.
Once inside https://teacherpresto.com , and in order to access the contracting of the different services, the User shall follow all the instructions indicated in the purchase process, which shall imply the reading and acceptance of all the general and specific conditions set out in https://teacherpresto.com .
4. AVAILABILITY AND SUBSTITUTIONS
For the provision of services, TEACHER PRESTO, will give access as follows:
Private one-to-one classes:
– Once the class has been booked, the student will be given access to the class on the day and time of the class booked.
– The client may cancel or modify their class booking with the teacher up to 12 hours before the time of the class booked, in the online mode, and up to 24 hours before the time of the class booked, in the face-to-face mode. In this case, the full amount will be refunded.
– In the event that the client cancels or modifies the class booked (online or in person) without meeting this minimum deadline, 50% of the amount will be refunded. If the client does not attend the class booked (online or in person), he/she will not receive a refund.
Group classes cannot be rescheduled, recovered or refunded, however, it may be possible for the student to view the recorded class. Cancellation of a group class will mean that the student will be removed from that group.
The client shall inform TEACHER PRESTO within the stipulated period and by any means permitted by law, of the modification or cancellation of the class booked and, in the event of a refund, the money for the booking will be returned to the cardholder who made the booking.

TEACHER PRESTO shall not be liable for any damages that may be caused to the USER as a result of failures or disconnections in the telecommunications networks that cause suspension, cancellation or interruption during the delivery of the online class.
5. PRICES
The prices of the services in euros will be those that appear expressly at the time of purchase on the website, including any taxes that may be applicable, and the website reserves the right to modify the particular conditions relating to the conditions of payment and scope of the services or products.
When there are offers or discounts, the original price and the discount applied shall be clearly stated.
No additional costs will be applied during the purchase process, unless the buyer voluntarily selects to add additional conditions to their purchase.
In any case, the final cost of the purchase will be shown to the user before finalizing and confirming the booking.
6. PURCHASE AND/OR CONTRACTING PROCESS
In order to make any purchase at https://teacherpresto.com, the customer must be of legal age.
For underage students, it is necessary that the purchase is made by their father/mother or guardian, as well as the acceptance and signature of the consent document to that effect in the case of underage students.
It will also be necessary for the customer to register at https://teacherpresto.com by means of a data collection form in which he/she provides TEACHER PRESTO with the information necessary for the purchase; this data shall in any case be truthful, accurate and complete with regard to his/her identity and the customer shall expressly consent to this by accepting TEACHER PRESTO’s privacy policy.
The steps to follow to make the purchase are:
1. Register on the website.
2. Select the group or teacher and the class.
3. Enter the details to make the payment.
4. Read the privacy policy and terms and conditions.
5. Proceed to the acceptance of the privacy policy and terms and conditions.
6. Receipt of the booking confirmation.
It is also recommended that the customer prints and/or keeps a copy on a durable medium of the terms and conditions of sale when making a reservation, as well as the proof of receipt sent by TEACHER PRESTO by e-mail.
You may request receipt of your invoice, subject to the provision of your invoicing details.
7. OPERATION OF THE SERVICE
The service will be carried out in the following way:
TEACHER PRESTO has a wide range of teachers, as well as classes with them. The user books either the group or the class with the teacher of his or her choice.
The classes will take place on the day and time established and accepted by the client.
If the classes are online, they will take place through the platform approved by TEACHERPRESTO.
If the classes are face-to-face, they will take place in the place and manner agreed upon by the teacher and student.
All students in group classes promoted on the TEACHERPRESTO website must be clients of TEACHERPRESTO and not external clients. Teachers may not include any student to a class that has not contracted the service through the TEACHERPRESTO website.
8. PAYMENT METHODS
The payment management is done through the Stripe platform, being the method of payment by credit or debit card (Visa or Mastercard).
The Stripe payment platform is adapted to PSD2. You can obtain more information at https://stripe.com/es/privacy .
The total amount of your booking will be charged to your card at the time of completion of the purchase process. Subsequently, a confirmation of acceptance of the booking will be sent.
Payment by credit/debit card guarantees you a simple and secure payment method. Your details will not be recorded in any database but your credit card details are entered on a secure page, which is transferred via SSL.
9. RETURNS AND CANCELLATION POLICY
According to the regulations, the consumer and user will have the right to WITHDRAW from the contract for a maximum period of 14 calendar days without having to indicate the reason and without incurring any cost, except those provided for in art. 107.2 and 108 of RD1/2007, of 16 November, which approves the text referred to in the General Law for the Defence of Consumers and Users.
This right of withdrawal is not applicable to, among others:
- Provision of services already performed or commenced.
- Contracts for the supply of sound or video recordings, discs and computer programs that have been unsealed by the consumer and user, as well as computer files, supplied electronically, that can be downloaded or reproduced immediately for permanent use.
The deadline for withdrawing from the contract for the provision of services is 14 calendar days from the day the booking is made, and the user must inform TEACHER PRESTO of his wish to exercise this right, which he may do by filling in the form at the end of this document.
The exercise of the right of withdrawal shall result in the suspension of the service.
TEACHER PRESTO shall send the consumer an acknowledgement of receipt of the withdrawal on a durable medium.
Withdrawal implies that TEACHER PRESTO will refund the amount already paid by the customer within a maximum period of 14 calendar days, following the same procedure chosen by the customer for payment.
Once we receive your request we will contact the customer to indicate the details of the refund.
The cancellation will take place as long as the contracted service does not fall within the exceptions indicated above:
- Provision of services already performed or commenced.
- Contracts for the supply of sound or video recordings, discs and computer programs that have been unsealed by the consumer and user, as well as computer files, supplied electronically, which can be downloaded or reproduced immediately for permanent use.
In the same way, as indicated in previous sections, the client may cancel or modify their class booking with the teacher up to 12 hours before the time of the class booked, in the online mode, and up to 24 hours before the time of the class booked, in the face-to-face mode. In this case, the full amount will be refunded.
In the event that the client cancels or modifies the class booked (online or in person) without meeting this minimum deadline, 50% of the amount will be refunded. If the client does not attend (online or in person) the class booked, he/she will not receive any refund.
Cancellation of a group class will result in the student’s removal from that group.
10. RECORDING
Classes will be recorded. The purpose is to collect and transfer personal data and images and/or videos of the students in order to provide teaching services and for subsequent viewing by the students. No automated decisions will be made based on the data provided. The legitimate bases in this treatment of personal data are: execution of a contract and the consent of the interested party. Data transfers are for the purpose of: Internet (training and delivery platforms), entity website, students. The data will be kept as long as the interested party does not request their deletion and or/fulfil the purpose for which the treatment is carried out, as described above.
11. LIABILITY AND EXEMPTION FROM LIABILITY
TEACHER PRESTO may suspend, withdraw or cancel part or all of the services subject to contract at any time and without prior notice. The foregoing provision shall not affect those services which are reserved for registered users or which are subject to prior contracting and which shall be governed by their specific conditions.
TEACHER PRESTO shall not be liable for any possible disagreements and/or conflicts between students and teachers, malpractice or negligence on the part of the latter, as well as for any event occurring in the relationship between teacher and student.
12. CUSTOMER SERVICE AND COMPLAINTS
In order to lodge any complaint or claim with TEACHER PRESTO, the customer should contact the customer service department via the e-mail address admin@teacherpresto.com.
According to the EU Consumer Online Dispute Resolution and in accordance with Art. 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform which is available at the following link: http://ec.europa.eu/consumers/odr/.
13. APPLICABLE LEGISLATION
The present conditions shall be governed by current Spanish legislation.
The language used shall be Spanish.
